Welcome to Trading AI. These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Trading AI regarding your use of our mobile application (the "App"). By accessing or using the App, you agree to comply with these Terms. If you do not agree, please discontinue use immediately.
1. Acceptance of Agreement
To use the App, you must meet the age and legal capacity requirements outlined in Section 5 below. The App is licensed to you strictly for personal, non-commercial use. You agree to use the App responsibly and not to engage in any unlawful, harmful, or objectionable conduct. This includes, but is not limited to, violating local or international laws, infringing on third-party rights, distributing harmful code such as viruses, or attempting to gain unauthorized access to the App's systems.
2. User-Generated Content
The App allows you to upload screenshots of financial charts to generate AI-driven Insights. While these images are processed temporarily to provide analysis, you retain full ownership and rights to any content you upload. However, you are solely responsible for the content you submit. You agree not to upload any material that is illegal, offensive, or violates the intellectual property or privacy rights of any third party.
3. Intellectual Property Rights
Trading AI owns all rights, title, and interest in and to the App, including all associated intellectual property. You are granted a limited, non-exclusive, non- transferable, and revocable license to use the App in accordance with these Terms. You are strictly prohibited from modifying, copying, selling, leasing, or creating derivative works based on the App. Furthermore, you may not reverse engineer, decompose, or attempt to derive the source code of the App, nor use it in any manner that violates these Terms.
4. Privacy
Your use of the App is also governed by our Privacy Policy, which details how we collect, use, and protect your information. By using the App, you consent to the data practices described in that policy.
5. Age Requirements
You must be at least 13 years old to use Trading AI. If you are under the age of 18, you represent that you are using the App with the explicit consent of a parent or guardian, in accordance with the laws of your jurisdiction.
6. NO FINANCIAL ADVICE & RISK DISCLOSURE
The insights, analysis, and data provided by Trading AI are entirely generated by artificial intelligence and are for informational and educational purposes only. THEY DO NOT CONSTITUTE FINANCIAL, INVESTMENT, LEGAL, OR TRADING ADVICE.
You acknowledge and agree that:
• AI models can and do make mistakes, hallucinate, or provide inaccurate data.
• Trading and investing involve substantial risk of loss, including the potential loss of your entire capital.
• You are solely responsible for your own trading decisions and their consequences.
Trading AI and its developers assume no liability for any financial losses, debts, or damages you may incur. You should strictly not rely on this App for making financial decisions.
7. Warranty Disclaimer
The App is provided on an "AS IS" and "AS AVAILABLE" basis. Trading AI expressly disclaims all warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non- infringement. We do not guarantee that the App will be error-free, secure, uninterrupted, or that any defects will be corrected. We explicitly do not warrant the accuracy, reliability, or correctness of any AI-generated content.
8. Absolute Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRADING AI, ITS DEVELOPERS, CREATORS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
(i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP;
(ii) ANY ERRORS, MISTAKES, OR INACCURACIES OF CONTENT OR AI PREDICTIONS;
(iii) ANY FINANCIAL LOSSES, DEBTS, OR DAMAGES INCURRED BY YOU RESULTING FROM YOUR RELIANCE ON THE APP.
YOU EXPRESSLY AGREE THAT YOUR USE OF THE APP IS AT YOUR SOLE RISK. UNDER NO CIRCUMSTANCES WILL THE DEVELOPER BE LIABLE TO YOU FOR ANY AMOUNT EXCEEDING THE AMOUNT YOU HAVE PAID TO THE APP, IF ANY, IN THE LAST SIX MONTHS.
9. Indemnification
You agree to defend, indemnify, and hold harmless Trading AI and its developer from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the App; (ii) your violation of any term of these Terms; or (iii) any financial decisions or actions you take based on the App's content.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of your country or state of residence, without regard to its conflict of law principles.
